A bench warrant is oftentimes issued by a Judge against an individual when the individual is either accused of committing some sort of prosecutable offense rather if it occurred prior to being in court or if the warrant was the result of an individualÕs failure to fulfill a presumed obligation ordered by the court such as an order to pay a fine, or failure to appear before the court on a specified date. The bench warrant is issued by the Judge in order to arrest the accused and bring them before the court to face prosecution for the alleged offense. Many people are not aware that a bench warrant can be removed or recalled for various reasons other than by getting arrested or turning themselves in. These reasons can remove personal liability (mens rea) from you and cause the Judge to recall/remove your bench warrant and provide you with another opportunity to fulfill the presumed obligation.
